Do I need to make a new Spanish Will?
Since EU law has implications for those living permanently in another country. The Regulation EU 650/2012 states:
“EU citizens habitually residing in Spain (residents) will be subject to the Spanish succession law, despite their nationality, unless they specifically state in their will the wish for the succession law of their country of origin to apply”.
The Regulation (EU) No. 650/2012, on jurisdiction, applicable law, recognition, and enforcement of decisions in matters of succession, as well as the creation of a European Certificate of Succession, came into effect on August 17, 2015.
This Regulation harmonizes the rules on succession within the European Union and establishes that, by default, the law applicable to the succession is that of the country where the deceased had their habitual residence at the time of death, unless they have expressly chosen the law of their nationality in their will.
This Regulation applies to all EU Member States, except Denmark and Ireland, which are not bound by its provisions.
Additionally, it introduces the European Certificate of Succession, a document that allows heirs, legatees, and executors to prove their status and exercise their rights in different EU countries without the need for additional procedures.
The will should clearly state which inheritance law you wish to be applied to your will and contain the necessary clauses to execute it in that way.
